Terms of Service

By commissioning Murmur, you are agreeing to the following terms and conditions.

Commissioned work created by Murmur (referred to as the Artist going forward) is for your personal enjoyment only. This means that the work created may not:

Be uploaded to other resources or social media without crediting the artist.
May not be used for commercial purpose or gain.
May not be used for third party endeavors.
May not be edited, traced, altered, sold or claimed to have been authored by anyone other than the Artist.

Client must be 18+. Some of my work is not safe for minors and I will not knowingly accept commissions from underage clients or for underage content. If discovered, you will immediately be blacklisted from further commissions and an artist beware will be posted alerting other artists.

Work Schedule: Typical turn around time is 1 (one) to 2 (two) weeks for completion depending on the work and complexity. This time starts from the day the Artist starts work, not the date commissioned.

Artist will provide wips on request once work has begun. Please do not ask for wips prior to the commission start. Queue and Trello will be made readily available to the client.

Artist will work on queue in the order received for the most part but reserves the right to choose pieces to work on at their discretion.

Changes/Alterations: Once the sketch is approved, only minor alterations can be requested. Major alterations are dealt with on a case-by-case basis and may be subject to an additional fee. The Artist will get permission before sending invoices for any additional charges. The Artist cannot always guarantee accommodation to changes and is not obligated to do so once the sketch is approved.

Refund and Cancellation Policy: Up until sketch approval, the Client is free to cancel at any point in time. Once sketch is approved, 100% refund is not possible. Unfinished works will be refunded at artist discretion based on current rates and the work that has been completed.

File Management: The artist is not responsible for lost or damaged files once the commission is complete. Be sure to back up any files received as there is no guarantee the Artist will keep them. Refunds will not be given for lost or damaged files.

Copyright Claim: The Artist retains copyright to the work commissioned. This means the Artist retains the right to reupload to their galleries at their discretion (unless otherwise requested). The Artist cannot resell or use the commissioned work for commercial gain. All copyrights to the subject/intellectual property remain with the copyright holders. At any time, the Client can request a commercial license of the piece for an additional charge but this is not assumed.

Personal Use: Personal use is allowed but do not remove the Artist’s watermark from any publicly posted image. Re-uploads should feature a working link back to any of the Artist’s pages (deviantart.com/murmury).
Examples of personal use: sharing with friends, re-uploading to an online gallery, web layout use, sites, blogs, and avatars.

Refusal Right: The Artist reserves the right to refuse any request for work and is not obligated to provide a reason.
